Definitions

  1. The privacy policy applies to the processing of every client’s personal data and the services offered to the client. The privacy policy provides information on how Pink Garlic collects, processes, stores, shares, deletes and protects the client’s personal data. Pink Garlic ensures lawful and fair processing of the client’s personal data.

Categories of Personal Data Processing

  1. The categories of personal data depend on the services and products used by the client. Pink Garlic is entitled to process the following categories of personal data:

Basis for Personal Data Processing

  1. Client’s consent. The client, as the data subject, gives consent (subject’s consent) for the collection and processing of personal data for specific purposes. The client’s consent is his/her free will and independent decision, which can be given/withdrawn at any time, thus allowing Pink Garlic to process personal data. Withdrawal of consent does not affect the lawfulness of processing or the quality of received services based on consent before withdrawal.

  2. To assess the client’s ability to fulfill contractual obligations;
  3. For effective cash flow management, including administration of client payments and debts;
  4. To provide technical support related to the provided services;
  5. For video surveillance security purposes and protection of Pink Garlic’s legitimate interests (ensuring property security);
  6. To promote industry development and offer new services;
  7. For statistical data processing and market analysis.

Acquisition of Personal Data

  1. Pink Garlic acquires the client’s personal data when the client:
  2. Subscribes to receive news from Pink Garlic;
  3. Purchases and uses products or services from Pink Garlic;
  4. Participates in contests, lotteries or surveys;
  5. Visits or browses Pink Garlic websites;
  6. Is filmed by video surveillance equipment;
  7. Pink Garlic and its authorized persons, based on the General Data Protection Regulation No.2016/679, are entitled to process the client’s personal data received from third parties (e.g., from leasing companies), if the client has agreed to it;
  8. Pink Garlic and its authorized persons, based on the General Data Protection Regulation No.2016/679, are entitled to process the client’s personal data received from the client.

Personal Data Retention Period

  1. Pink Garlic is entitled to process and store personal data as long as:
  2. Until the client’s consent to the processing of personal data is withdrawn;
  3. The period necessary for the realization and protection of Pink Garlic’s legitimate interests;
  4. The personal data retention period is specified in legal acts;
  5. There are contractual obligations in force between the client and Pink Garlic;
  6. Until the purpose of personal data use specified at the time of receipt is achieved.

Sharing of Personal Data

  1. Pink Garlic provides the client’s personal data only to the necessary and sufficient extent in accordance with legal requirements and taking into account the objective circumstances of the specific situation;
  2. If necessary, Pink Garlic transfers the client’s personal data to Pink Garlic’s authorized persons, based on the General Data Protection Regulation No.2016/679 and/or partners, agents, service providers involved in ensuring and improving the quality of the products and services ordered or used by the client;
  3. Pink Garlic is entitled to transfer the client’s personal data to law enforcement authorities, other state and municipal institutions, if this arises from legal acts or the relevant institution’s information request.

  1. To protect the client’s personal data from unauthorized access, accidental loss, destruction or disclosure, Pink Garlic applies modern technologies and observes technical and organizational requirements;
  2. Pink Garlic carefully checks all authorized persons, partners, agents, service providers, company employees who process the client’s personal data, as well as evaluates the application of appropriate security measures and the storage of personal data in accordance with legal requirements;
  3. Pink Garlic does not assume responsibility for any unauthorized access to personal data and/or loss of personal data if it is not dependent on Pink Garlic (e.g., due to the client’s fault and/or negligence).

Client Rights

  1. The client has the right at any time to refuse to receive commercial communications and to object to the profiling of their personal data;
  2. Withdrawal of consent does not affect the lawfulness of personal data processing and/or the quality of received services based on consent before withdrawal;
  3. The client has the right to correct all personal data held about themselves;
  4. The client has the right to request the deletion or restriction of the processing of personal data that is no longer necessary for the purposes for which it was collected and processed (the right “to be forgotten”) by submitting an application.
  5. The client has the right to obtain information about those natural or legal persons who have received information about this client;
  6. The client has the right to receive or transfer their personal data to another data controller (“data portability”). These rights apply only to data provided by the client to Pink Garlic, based on their consent or contract, and if processing is carried out automatically. To exercise the aforementioned rights, a written application must be submitted.
