Definitions

Personal data – any information relating to an identified or identifiable natural person (data subject).

Client – a natural person (data subject) who can be directly or indirectly identified by reference to an identifier, using personal data held in the personal data processing system.
Client's “consent” – any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.
Controller – a natural or legal person, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data and provides access to personal data.
Authorized person – a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Profiling is carried out to assign bonuses, create and send individual offers and greetings, which are offered only for direct marketing (business purposes) and will not have legal consequences for the client.

Processing of Personal Data

Pink Garlic collects, processes, stores, shares, deletes and protects the client’s personal data based on the General Data Protection Regulation No.2016/679 and other applicable laws and regulations of the Republic of Latvia.
In accordance with the applicable laws and regulations governing the personal data processing system, Pink Garlic observes the following principles:
Pink Garlic ensures lawful and fair processing of personal data;
The processing of received personal data is carried out for specific purposes;
The received personal data are adequate and relevant;
The received personal data are accurate;
The received personal data are not kept longer than necessary and are deleted upon achieving the specified purpose;
Pink Garlic processes personal data in compliance with the rights of natural persons;
Pink Garlic ensures the secure storage of personal data;
Pink Garlic does not provide received personal data to other companies or outside the European Union, ensuring secure and adequate protection, based on and in compliance with the applicable laws and regulations and the General Data Protection Regulation No.2016/679.

The privacy policy applies to the processing of every client’s personal data and the services offered to the client. The privacy policy provides information on how Pink Garlic collects, processes, stores, shares, deletes and protects the client’s personal data. Pink Garlic ensures lawful and fair processing of the client’s personal data.

Categories of Personal Data Processing

The categories of personal data depend on the services and products used by the client. Pink Garlic is entitled to process the following categories of personal data:
Data provided by the client to Pink Garlic;
Name, surname, personal code or date of birth;
Correspondence address, phone number, email address;
Bank data;
Video surveillance recordings and images;
Communication data. Information from the email address – letters related to the client’s communication with the company;

Data, time, internet browsing volume.

Basis for Personal Data Processing

Client’s consent. The client, as the data subject, gives consent (subject’s consent) for the collection and processing of personal data for specific purposes. The client’s consent is his/her free will and independent decision, which can be given/withdrawn at any time, thus allowing Pink Garlic to process personal data. Withdrawal of consent does not affect the lawfulness of processing or the quality of received services based on consent before withdrawal.
Pink Garlic’s legitimate interests, which are based on the provision of quality services. Pink Garlic has the right to process the client’s personal data to the extent that is objectively necessary and sufficient to ensure timely, quality, and convenient service. Purposes of Personal Data Processing

For the conclusion and performance of a contract with the client;
To assess the client’s ability to fulfill contractual obligations;
For effective cash flow management, including administration of client payments and debts;
To provide technical support related to the provided services;
For video surveillance security purposes and protection of Pink Garlic’s legitimate interests (ensuring property security);
To promote industry development and offer new services;
For statistical data processing and market analysis.

Acquisition of Personal Data

Pink Garlic acquires the client’s personal data when the client:
Subscribes to receive news from Pink Garlic;
Purchases and uses products or services from Pink Garlic;
Participates in contests, lotteries or surveys;
Visits or browses Pink Garlic websites;
Is filmed by video surveillance equipment;
Pink Garlic and its authorized persons, based on the General Data Protection Regulation No.2016/679, are entitled to process the client’s personal data received from third parties (e.g., from leasing companies), if the client has agreed to it;
Pink Garlic and its authorized persons, based on the General Data Protection Regulation No.2016/679, are entitled to process the client’s personal data received from the client.

Personal Data Retention Period

Pink Garlic is entitled to process and store personal data as long as:
Until the client’s consent to the processing of personal data is withdrawn;
The period necessary for the realization and protection of Pink Garlic’s legitimate interests;
The personal data retention period is specified in legal acts;
There are contractual obligations in force between the client and Pink Garlic;
Until the purpose of personal data use specified at the time of receipt is achieved.

Sharing of Personal Data

Pink Garlic provides the client’s personal data only to the necessary and sufficient extent in accordance with legal requirements and taking into account the objective circumstances of the specific situation;
If necessary, Pink Garlic transfers the client’s personal data to Pink Garlic’s authorized persons, based on the General Data Protection Regulation No.2016/679 and/or partners, agents, service providers involved in ensuring and improving the quality of the products and services ordered or used by the client;
Pink Garlic is entitled to transfer the client’s personal data to law enforcement authorities, other state and municipal institutions, if this arises from legal acts or the relevant institution’s information request.

Personal Data Protection

To protect the client’s personal data from unauthorized access, accidental loss, destruction or disclosure, Pink Garlic applies modern technologies and observes technical and organizational requirements;
Pink Garlic carefully checks all authorized persons, partners, agents, service providers, company employees who process the client’s personal data, as well as evaluates the application of appropriate security measures and the storage of personal data in accordance with legal requirements;
Pink Garlic does not assume responsibility for any unauthorized access to personal data and/or loss of personal data if it is not dependent on Pink Garlic (e.g., due to the client’s fault and/or negligence).

Client Rights

The client has the right at any time to refuse to receive commercial communications and to object to the profiling of their personal data;
Withdrawal of consent does not affect the lawfulness of personal data processing and/or the quality of received services based on consent before withdrawal;
The client has the right to correct all personal data held about themselves;
The client has the right to request the deletion or restriction of the processing of personal data that is no longer necessary for the purposes for which it was collected and processed (the right “to be forgotten”) by submitting an application.
The client has the right to obtain information about those natural or legal persons who have received information about this client;
The client has the right to receive or transfer their personal data to another data controller (“data portability”). These rights apply only to data provided by the client to Pink Garlic, based on their consent or contract, and if processing is carried out automatically. To exercise the aforementioned rights, a written application must be submitted.
